The DBA Process

Agents need to create and register their own trademark names within the county they live.  The process is very simple, but does require patience as it may take upwards of three weeks to complete the process.

Step One–Select a company name/Trade Name.  Obviously this has to be a name not already in use.  To see if the name you want is available, you must call the Clerk of Superior Court in the county of your corporate address.  (you can work in any county, but you will have only one corporate address)

Step Two–From your County of record, download and complete a “Trade Name Application”.  The Clerk of Courts can tell you where you can download or get a copy of the application.  Under NO circumstances should you compete the paperwork yourself.   Please make sure to contact Wynd Realty BEFORE completing your application.    Wynd Realty will not be responsible for agents attempting to create a DBA on their own.   Every County has an application fee that will vary, usually around $25-$30.   (Since this writing, Fulton County has raised its trademark application from $29 to $165!) It will take ten days to two weeks to have your application verified.  You will receive notification through the mail.

Step Three–Advertise your company for two consecutive weeks in the official record of the County.  Every County has an official record.  ( for example, Fulton County Daily Report) Call the Clerks office to find out the details of your County.  Ad cost will vary, but expect to pay $20 per ad.  Again, we will take care of the advertising for you.  Do not attempt to run an ad yourself.

Step Four–We will set up your company with the Georgia Real Estate Commission and our MLS provider, FMLS.  This process takes upwards of ten days to complete.  Wynd Realty has a $25 set-up fee for this step.  The fee will be added to your monthly bill.  There are no additional charges for being a DBA company under Wynd Realty.

The entire process can take three weeks.
